Tydings Partner and Family Law Co-Chair Ferrier R. Stillman was recently interviewed by The Daily Record for its Maryland Family Law Update about a Maryland law that may give divorcing spouses another option when determining the disposition of the marital home.
The law allows a qualifying spouse, in certain circumstances, to assume an existing conventional mortgage rather than refinance the property — potentially allowing that spouse to keep the house and retain the existing interest rate.
Ferrier discussed the potential benefits of the new law, as well as practical considerations divorcing couples may encounter when working with lenders and determining whether one spouse can independently qualify for the existing mortgage.
